1. Definitions

For the purposes of these Terms:

  • "Platform" refers to the Prismaway OÜ website, mobile applications, and related services enabling Dota 2 items trading.
  • "Items" means virtual cosmetic items from Dota 2 available for purchase or trade.
  • "Tokens" are the virtual currency used exclusively on our Platform for item transactions.
  • "User" refers to any individual or entity accessing our Platform.

2. Account Registration and Security

2.1 Eligibility Requirements

To register an account, you must:

  • Be at least 18 years old or the age of majority in your jurisdiction.
  • Provide accurate and complete registration details.
  • Not reside in a restricted jurisdiction (see Section 2.3).
  • Not have any previously suspended or terminated accounts.

2.2 Account Security

You are responsible for:

  • Keeping your login credentials confidential.
  • All actions performed through your account.
  • Promptly reporting any unauthorized account access to us.

2.3 Geographic Restrictions

The Platform is unavailable in certain jurisdictions listed here, including Afghanistan, Cuba, Iran, North Korea, Syria, Russia, Belarus, Crimea, Donetsk, Luhansk, Myanmar, Central African Republic, China, Democratic Republic of Congo, Lebanon, Libya, Mali, Nicaragua, Somalia, Sudan, Venezuela, Yemen, Zimbabwe. We may restrict access from additional regions at our discretion.

3. Token System and Financial Terms

3.1 Description and Intended Use

  • 3.1.1 The Platform operates using an internal accounting unit referred to as the DVT (Dota Volt Token).
  • 3.1.2 The DVT does not qualify as a cryptocurrency, digital asset, security token, or any financial instrument under applicable laws. It is strictly a non-transferable, non-tradable accounting unit intended for internal use only.
  • 3.1.3 The primary function of the DVT is to facilitate streamlined internal bookkeeping, balance tracking, service usage, and user engagement with the Platform's features.

3.2 Value and Conversion Rate

  • 3.2.1 The DVT is linked to the euro (EUR) at a fixed conversion rate of 1 DVT = 1 EUR.
  • 3.2.2 This rate is applied exclusively within the Platform to calculate user balances and transaction values.
  • 3.2.3 When users make deposits, the amount is converted to DVT on a one-to-one basis. Account balances are displayed in DVT, corresponding directly to the equivalent amount in EUR.

3.3 Regulatory and Legal Classification

  • 3.3.1 The DVT is not recognized as legal currency, electronic money, or a payment method under EU Directive 2009/110/EC or any other relevant regulatory standard.
  • 3.3.2 Holding DVT does not provide any rights to ownership, voting, dividends, or participation in the Platform's governance or its parent company’s equity.
  • 3.3.3 DVTs cannot be traded, sold, transferred, exchanged, pledged, or utilized outside of the Platform’s internal environment.
  • 3.3.4 The issuance and use of DVT are not intended for any speculative, financial, or investment-related purposes.

3.4 The Virtual Internal Token

  • 3.4.1 The Platform utilizes an internal virtual accounting unit called the Dota Volt Token (“DVT”).
  • 3.4.2 DVT is not a cryptocurrency, digital asset, security token, or financial instrument as defined under applicable law. It is a non-transferable, non-tradable unit of account, used solely for internal transactional and operational purposes within the Platform.
  • 3.4.3 The use of DVT allows for efficient internal accounting, balance management, service consumption, and user interaction with Platform features.
  • 3.4.4 DVT is pegged to the euro (EUR) at a fixed exchange rate of 1 DVT = 1 EUR.
  • 3.4.5 This fixed rate is used exclusively within the Platform to determine user balances and transactional amounts.
  • 3.4.6 Deposits made by a user are automatically converted to DVT on a 1:1 basis. Users can view their balance in DVT, which reflects the corresponding EUR value.
  • 3.4.7 DVT is not legal tender, electronic money, or a payment instrument under EU Directive 2009/110/EC or any other applicable regulatory framework.
  • 3.4.8 DVT does not grant ownership rights, voting rights, dividends, or any form of participation in the governance or equity of the Platform or its parent company.
  • 3.4.9 DVT cannot be sold, transferred, exchanged, pledged, or used outside the scope of the Platform.
  • 3.4.10 The existence and use of DVT do not imply any speculative, investment, or financial activity.
  • 3.4.11 Users may use their DVT balance for any permitted activities or services available on the Platform, including but not limited to:
  • - Accessing digital services or products
  • - Making internal purchases

3.5 No Financial or Investment Services

  • 3.5.1 The Platform is not a financial institution and does not provide investment, banking, or payment services. DVTs are not e-money, securities, or other financial instruments. We do not offer withdrawal or exchange of DVTs for real-world currency.

4. Prohibited Conduct

You agree not to:

  • Manipulate item prices or market dynamics.
  • Use unauthorized third-party software or bots.
  • Engage in fraudulent activities, including chargebacks.
  • Transfer accounts or items outside the Platform.
  • Violate Steam’s Terms of Service or Dota 2’s EULA.
  • Bypass Platform security measures.

5. Intellectual Property

All Platform content, including but not limited to:

  • Website design and code.
  • Trademarks and logos.
  • Proprietary trading systems.

is owned by Prismaway OÜ or its licensors and protected by intellectual property laws.

6. Disclaimers and Limitation of Liability

6.1 Service Availability

The Platform is provided "as is" without warranties. We do not guarantee continuous access and may modify or discontinue services at any time.

6.2 Item Valuation

We are not liable for:

  • Fluctuations in item market values.
  • Changes by Valve to Dota 2 or its economy.
  • External market conditions.

6.3 Liability Cap

Our total liability is limited to the amount spent on DVTs in the 6 months prior to any claim.

7. Termination and Suspension

We may suspend or terminate accounts for:

  • Breaches of these Terms.
  • Suspicious activities.
  • Law enforcement requests.

Termination results in forfeiture of all DVTs and items without compensation.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes will be subject to the laws of England and Wales, without prejudice to consumer protections under the mandatory laws of your country of residence.

9. General Provisions

  • These Terms form the entire agreement.
  • Failure to enforce any provision is not a waiver.
  • If any provision is invalid, the remaining provisions remain effective.

10. Refunds and Right of Withdrawal

10.1 Refund Eligibility

  • 10.1.1 You may be eligible for a refund under the following conditions:
  • Technical Issues: If a purchased digital item (e.g., Item or DVT) is unusable due to technical issues, contact info@dotavolt.com. If unresolved within 5 business days, a refund will be issued.
  • Unauthorized Charges: Report unauthorized charges promptly. Verified unauthorized transactions will be refunded.
  • Payment Errors: For overcharges or duplicate payments, provide evidence to info@dotavolt.com for a refund of the excess amount.
  • Fraud Prevention: We may issue refunds for transactions deemed fraudulent to protect Platform integrity.
  • All other DVT and item purchases are non-refundable, except as required by law.

10.2 Right of Withdrawal (EEA, UK, Switzerland)

  • If you reside in the EEA, UK, or Switzerland, you have a 14-day right to withdraw from digital content purchases (e.g., DVTs or Items) without stating a reason.
  • The withdrawal period ends 14 days after the digital content is delivered to your account.

10.3 Waiver of Withdrawal Right

  • By purchasing digital content and consenting to immediate delivery, you waive your right of withdrawal once the content is delivered, per Article 16(m) of the EU Consumer Rights Directive and equivalent UK/Swiss laws.

10.4 How to Withdraw

  • To withdraw (if eligible), notify us at info@dotavolt.com within 14 days, including:
  • Your name and email used on the Platform.
  • Purchase date.
  • Description of purchased content.
  • A clear statement of withdrawal intent.

10.5 Reimbursement Process

  • If approved and the content is unaccessed, we will refund all related payments within 14 days of receiving your withdrawal notice.
  • Refunds will use the original payment method unless otherwise agreed, with no fees incurred.
  • Refunds may take up to 30 days to appear in your account, depending on your payment provider.
